Mamta Banerjee can make any statement against the Governor, provided..., a big decision of Calcutta High Court

Kolkata. The Calcutta High Court has clearly stated that Bengal Chief Minister Mamata Banerjee is free to make any statement about Governor C.V. Anand Bose. But that statement should not go beyond the limits of freedom of expression and public duty. The division bench of Justice Biswarup Chaudhary and I.P. Mukherjee modified the order of the single bench of the High Court and said that “if this is not done, the appellants are at risk of claiming heavy damages and other stringent action.” Mamata Banerjee and Trinamool Congress leader Kunal Ghosh had filed an appeal before the division bench challenging the interim order of the single bench of the High Court.

In its order, a single bench of the Calcutta High Court had directed the Chief Minister and three others not to make any derogatory or false statement against the Governor through publication and social media platforms till August 14. The court said that the lawyers of the respondents in the defamation suit have very rightly said that the statements included in the single judge’s decision have not been declared prima facie derogatory or false to the Governor.
