Supreme Court: Five judge supreme court bench to review ruling on ‘automatic vacation of stay’ | India News


NEW DELHI: The Supreme Court on Friday agreed to test the correctness of its March 2018 judgment fixing a sixmonth expiry period on stay orders to expedite long-winding trial proceedings, and said automatic vacation of stay orders after six months could result in “serious miscarriage of justice” in some cases.
Senior advocate Rakesh Dwivedi, appearing for Allahabad HC Bar Association, argued that the issue before a three-judge bench led by Justice Adarsh Goel in 2018 was whether order on framing of charges was an interim order amenable to challenge before the HC.The issue of whether an expiry period should be affixed on stay orders was not at all debated before the court, he said.
Abench of Chief Justice DY Chandrachud and Justices J B Pardiwala and Manoj Misra said, “When a high court grants stay in a criminal or civil case, it can’t be au tomatically vacated. The delay cannot always be attributed to the parties. Sometimes, it is because the cases do not get listed before the courts for a variety of reasons.”
The CJI-led bench said it had serious reservations over the direction that a stay order’s lifespan wouldn’t exceed six months unless extended by an express order of the HC, even though it is true that any stay operating indefinitely causes long delays in trial of civil and criminal cases.

The principle of automatic vacation of stay orders after six months, as laid down in the SC’s March 28, 2018 judgment in ‘Asian Resurfacing of Road Agency’ case, “is liable to result in serious miscarriage of justice”, the bench said. It said since the earlier judgment was passed by a three-judge bench, the testing of the rul ing’s correctness has to be referred to a five-judge bench.
The 2018 judgment was authored by Justices Adarsh Goel and Navin Sinha with whom Justice RF Nariman had agreed. Attempting to remedy long delays in court trials because of stay orders operating indefinitely, Justices Goel and Sinha had said, “We consider it appropriate to direct that in all pending cases where stay against proceedings of a civil or criminal trial is operating, the same will come to end on expiry of six months from today unless in an exceptional case by a speaking order such stay is extended.”
“In cases where stay is granted in future, the same will end on expiry of six months from the date of such order unless similar extension is granted by a speaking order. The speaking order must show that the case was of such exceptional nature that continuing the stay was more important than having the trial finalised,” the Supreme Court had said.


I-T officer who assaulted TC with chappal gets 6-mth RI, fined Rs 1L | Mumbai News


MUMBAI: Observing that the accused is a public servant who was working as an assistant income-tax commissioner at the time of alleged offence and assaulted the victim, a ticket checker, with a chappal for discharging his public duty at a railway station in 2016, a sessions court on Tuesday convicted and sentenced the man to six months’ rigorous imprisonment and also fined him Rs 1 lakh.
The accused, Rishikumar Singh, had attacked the victim after he was stopped for travelling without a ticket. Judge SD Tawshikar said, “….considering the increase in the incidents of assault on public servant and the peculiar manner of assault on the victim, sentence of imprisonment as well as fine is necessary to be awarded”.
The judge further said that while the victim, Sujitkumar Gupta, had not suffered any visible injuries, he had dealt with great insult and mental agony. Out of the total fine amount, Rs 50,000 is to be given to the victim as compensation.
Among the 10 witnesses that deposed were the victim and two other ticket checkers. The victim told the court that the incident took place on October 8, 2016, at 7.15pm when he asked the accused to show his ticket on seeing him hurriedly going to platform number 14-15 at CSMT. The accused replied, “I am an income-tax commissioner, I don’t need to take ticket, who are you to ask me about..,” and then hit him with his chappal on his cheeks when stopped from leaving.
The accused denied the allegations and claimed that the victim had demanded a bribe, and that he had no authority to levy a fine as he was not wearing his blazer and therefore not in full uniform.
In the 41-page judgement made available on Thursday, the judge said that the submissions of the accused were an afterthought and completely vague and baseless.
The judge refuted the defence claims that since the victim was not wearing his full uniform he was not discharging his duty as a public servant. “… not wearing full uniform while discharging the duty would not change the nature of their duty i.e, a public duty. Not wearing blazer or tie is a minor and technical thing, which would not take away his status of being a public servant and discharging duty in said capacity. His being present on the spot i.e. at railway station by wearing a white shirt with an identity card in his neck and asking for a ticket is sufficient to give reasonable belief to everyone there that he is a TC,” said the judge, adding that
“there is ample oral evidence adduced on record to boost prosecution case.”


Sunday service a priority, Election Commission defers Mizoram result | India News


Mizoram‘s assembly election verdict won’t be known until Monday, with the Election Commission on Friday giving in to pressure from the church, community organisations and political parties to postpone the vote count by a day to enable the Christian-majority state to attend Sunday service.
Counting in the other four states that went to polls between November 7 and 30 – Chhattisgarh, Madhya Pradesh, Rajasthan and Telangana – will take place as scheduled on Sunday.

“The commission received several representations from various quarters, requesting a change in the date of counting from December 3 to a weekday on the ground that Sunday holds a special significance for the people of Mizoram,” the EC said. The order came hours after the Mizoram NGO Coordination Committee organised a public gathering in the state capital of Aizawl and passed a two-point resolution.

DUBAI: The opening plenary of the UN climate conference here on Friday saw PM Narendra Modi as the only head of state/government on the dias underlining India’s growing geopolitical clout in climate diplomacy, reports Vishwa Mohan. Along with the Indian PM, others on the dias were CO president Sultan Al Jaber, UN Framework Convention on Climate Change president Simon Stiell and UN general assembly president Dennis Francis.

Reiterating that left-wing extremism was now in its last stages with the counter-Naxal forces increasingly restricting the area of operation of Maoists, home minister Amit Shah on Friday exhorted BSF, CRPF and ITBP to be ready to deal it the final blow with renewed resolve and enthusiasm.
BSF, CRPF and ITBP are the three central para-military forces deployed in LWE-hit areas, spearheading the fight against Naxalites in close coordination with the police of the affected states. “This has brought significant successes in that the area of Maoists’ influence has shrunk to 176 police stations across 45 districts from 455 police stations across 96 districts 10 years ago. Incidents of Maoist violence have dipped by 52% and resulting deaths by 70% in the last decade,” Shah shared in his address at the BSF’s 59th Raising Day function here.
“The day is not far when the country will be completely free of left-wing extremism. 199 security camps have been set up in areas where Naxals were pushed back, to fill the security vacuum. The patrolling of these areas has choked the resources of left-wing extremists and helped us take control of what were once Maoist strongholds of Jharkhand such as Budha Pahad and Chakarbanda. The final battle against left wing extremism is still on in Kolhan division and some areas of Jharkhand and we are sure to win this battle,” assured the home minister.
Also commending the BSF for keeping the borders safe, Shah said fencing on its own cannot secure a country’s borders.
“It only helps the border guarding personnel to keep the frontiers safe,” he said and added that 560 km of fencing to plug the identified gaps along India’s western and eastern borders, which were facilitating infiltration and smuggling, has been completed in the past nine years. “The remaining 60 km fence will be done in the next two years, fully securing both Indo-Pakistan and Indo-Bangladesh borders,” announced Shah.
The home minister on Friday said the BJP governments under the leadership of both Atal Bihari Vajpayee and Narendra Modi have prioritised border security. While Vajpayee government approved integrated border management plan focused on ‘one-border-one-force’ principle, the Narendra Modi government has in the last 10 years worked relentlessly not only to enhance border security with but also improve infrastructure with funding running into thousands of crores. Also connectivity – be it via road, railways, waterways, telecommunication or people-to-people connect – and reach of the Centre’s welfare schemes has been strengthened in the border villages.
Shah particularly praised the BSF’s contribution in ensuring the implementation of people-inclusive border management policy of the Modi government. On its part, he said, Modi regime has over the last 10 years floodlit 1,100 km of border stretches, erected 542 border outposts, and set up 510 observation towers including the very first one in Harami Nala in Sir Creek area, besides providing power connectivity in 637 border outposts and water connections in 500 BOPs.


Mahua Report: Mahua Moitra report on day 1, winter session set for a fiery start


NEW DELHI: Setting the stage for a fiery start to the winter session of Parliament, the Lok Sabha ethics panel’s report on Trinamool Congress MP Mahua Moitra will be tabled on the very first day of the session on Monday.
In the list of business uploaded on the Lok Sabha website, the matter is mentioned at item number 5 as per which ethics committee chairman and BJP MP Vinod Kumar Sonkar and his party colleague Aparajita Sarangi will lay the report a few minutes after the start of the session.
The committee had on November 8 adopted a report recommending Moitra’s expulsion from the lower House over ‘cash-for-query’ charges.
While six members had voted in favour of the report, including Congress’s rebel MP Praneet Kaur, four opposition MPs had opposed it.
Sources said after laying of the report, junior parliamentary affairs minister Arjun Ram Meghwal is likely to move a motion to accept the report and adopt the recommendations of the committee, which, as per sources, has recommended Moitra’s expulsion. Sources said the opposition may ask for a discussion, which, however, is the sole discretion of the speaker who may allow it or adopt the motion without any debate.
Since the BJP has a majority, adoption of the report is a legislative formality, paving the way for the Trinamool MP’s expulsion. This is the first time since the ethics committee came into existence in 2000 that it has recommended expulsion of a parliamentarian. The privileges committee has taken such steps, including recommending expulsion of 10 MPs in the 2005 cash-for-query scam.


Tamil Nadu woman calls off wedding as 'friends dislike groom', found hanging 4 days later


RANIPET: A 20-year-old woman who called off her wedding, allegedly after her friends said they disliked the groom, was found hanging at her home in a village in Tamil Nadu‘s Ranipet on Friday, reports Bosco Dominique.
Police said the woman’s parents had chosen to get her married to her 30-year-old cousin and she had initially consented to the union. The elders of both families had fixed the wedding date on November 29 at a village temple.On November 27, however, she approachedArakonam all-women PS and said she had decided to call off the wedding as her friends didn’t like the groom and she too didn’t want to marry her cousin 10 years elder than her.
While cops initially suspected that she was in love with someone else, the woman claimed she was ready to marry anyone her parents chose but the groom should have her approval. Cops invited both families for a peace talk, but in vain. The woman also refused to go with her parents following which the cops accommodated her at a government home in Walajapet in the district.
The woman, however, later changed her mind and gave an undertaking stating her decision to return home.
She left the government accommodation on Thursday morning and was found hanging at home the next day. Nemili Police registered a case and launched a probe.

The PM’s appeal came during his address to global leaders at the inauguration of the high-level segment of heads of state/government at CO.
In October, India had launched the country’s Green Credit Programme(GCP) to encourage environmentally friendly practices. It is an innovative market-based mechanism designed to incentivise voluntary environmental actions.In the initial phase, the programme focuses on two key activities – water conservation and afforestation – which will generate credits and can be traded on the green credit platform.
The PM’s offer to host the 33rd session of the climate conference appears to be part of several initiatives his government has taken to try to change the perception of India being part of the problem of global warming to being a prominent part of the effort for a solution to deal with the climate crisis.
Modi said countries have to be “decisive” and “work in unity” while giving due carbon space in the Global Carbon Budget to all developing countries to grow economically. Emphasising “innovation”, he cited the example of how his suggestion of Mission LiFE (lifestyle for environment) at COP26 had become an important tool to reduce emissions through environmentally conscious lifestyles.
Calling the GCP yet another initiative in this direction, he urged world leaders to join it and reminded the participants how G20 under India’s presidency focused on a similar pro-planet approach of sustainable future through green development pact that includes agreeing to work for tripling global renewable energy capacity by 2030 and making efforts to increase climate finance from billions of dollars to trillions.
The GCP is independent of the Carbon Credit Trading Scheme where credits are assigned to projects/activities that can reduce greenhouse gases. Carbon credits are measured in tonnes of carbon dioxide-equivalent and then priced and traded. People and businesses that wish to offset their emissions can buy these credits and ‘neutralise’ their carbon footprint. Green credits, on the other hand, can be generated by taking water conservation measures or through plantation. Since an environmental activity generating green credit may have climate co-benefits, such as reduction of carbon emissions, the GCP may also get carbon credit from the same activity under the scheme.
The PM also flagged how India was among the very few countries who were on track to meet their 2030 nationally determined contribution (NDC) – voluntarily pledged climate actions under the Paris Agreement. “India has presented an example of a balance between ecology and economy before the world. India’s contribution to the global carbon emission is merely 4% despite the country having 17% of the world’s population,” Modi said.

BULANDSHAHR: UP Police — which was scratching its head over a murder case for nearly two weeks — on Friday claimed to have solved the mysterious killing of a 48-year-old property dealerTejpal Singh, whose body was recovered from his home in Bulandshahr on November 15. Investigations revealed a sordid saga where the hunter had become the hunted.
Singh had hired two contract killers to eliminate his wife but the killers, unable to execute the murder, instead turned upon Singh since they did not want to part with the Rs 3 lakh advance paid to them by him.
Police said Tejpal was shot dead in his house in the Kakod area. The place was locked from outside and cops had to break the door open. A case was lodged the same day against “unidentified persons” on the complaint of Singh’s wife Babita Devi.
SP (Bulandshahr), Surendra Tewarisaid, “The family suspected two persons, Deep Solanki and Balraj. The duo were detained on Thursday and finally spilled the beans during questioning.”
“Tejpal had a property dispute with his wife and had hired contract killers to eliminate her. He promised Rs 6 lakh for the job and gave Rs 3 lakh in advance. The killers did a recce and found it difficult to murder the woman due to the CCTVs installed around her house. Not wanting to return the advance, they instead decided to shoot him dead,” the SP added.
Meanwhile, Tejpal’s wife Babita said she never had any intention of killing her husband and that she’d been living separately from him.


BJP: BJP off the blocks to woo independents, smaller parties in Raj | India News


JAIPUR: The BJP brass in Rajasthan has started making overtures to at least three smaller entities and a group of around 20 independent candidates, some of whom the saffron party had denied tickets, in preparation for a potential split verdict in the desert state.
The list of individuals approached so far includes “rebel” candidates Rohitash Sharma, Chandrabhan Singh Akhya and Ravindra.
