The ruling TMC in West Bengal plans to table a resolution during the Winter session of the assembly, condemning alleged constitutional violations by the central government. The resolution titled “commemorating Constitution Day” will be discussed on November 28. TMC Chief Whip expects Chief Minister Mamata Banerjee to participate in the discussion. The opposition BJP intends to oppose the resolution and requests a resolution on the “worsening law and order situation in the state.” The session will also include bills on salary hikes and pending bills with Governor C V Ananda Bose.
Supreme Court reaffirms Governor cannot use constitutional powers to thwart normal course of lawmaking by State
The Supreme Court has ruled that the Governor, as an unelected Head of State, cannot use their constitutional powers to obstruct the normal lawmaking process of state legislatures. The court emphasized that when the Governor withholds assent under Article 200, they must follow the course of action indicated in the first proviso. The Governor’s power should not allow them to veto the functioning of a duly elected legislature without any further recourse. The court clarified that this principle also applies to Money Bills, which are excluded from the Governor’s power to return a Bill. In a parliamentary form of democracy, real power lies with elected representatives and the Governor acts on the ‘aid and advise’ of the Council of Ministers, except in areas of discretionary power. The Governor is a constitutional statesman, guiding the government on matters of constitutional concern.
