In the decision, the Supreme Court had said that in this case, neither the power of attorney of any lawyer was presented by the state government, nor was any lawyer present during the hearing. After which the government had presented a review petition.

The accused has misused the bail Appearing on behalf of the state government, Additional Advocate General Shiv Mangal Sharma said that apart from Rajasthan, a total of 7 cases including cow smuggling are registered against the accused in Uttar Pradesh. Of these, 4 are of similar nature (cow smuggling).

The accused has been declared absconding in many cases. Non-bailable warrants are pending against him in Sambhal, Hathras, Agra and Chandauli of Uttar Pradesh. The accused has a record of misusing bail.

The accused is a habitual cow smuggler. If the accused remains outside, he can commit a similar crime again.

The court had said in its decision – The accused is a resident of Uttar Pradesh, hence there is a possibility of his being absent during the trial in Rajasthan. According to the police report, on February 13, 2021, during police patrolling in Nadauti police station area of ​​Karauli district, a container coming from Gangapur City was stopped on the suspicion of cow smuggling. On examination of the container, it contained 26 cows of different ages. Among these, 3 calves aged between 3 to 6 years and a cow of about 5 years were found dead. The container was confiscated. The driver and another accused were arrested. But the third person, later identified as Nazim Khan, had escaped. He was arrested only on 30 April 2024.
