Use of social media for dissent may have disastrous effect: CJI Chandrachud | India News


NEW DELHI: Chief Justice D Y Chandrachud on Friday said the increasing adoption of private corporation-owned social media platforms as a medium by civil rights groups for dissent activism and expression of free speech could have a disastrous effect as these unaccountable mega entities almost become repository of powers earlier available to governments reined in by constitutions and electorate.
Delivering the Justice V M Tarkunde Memorial lecture on the topic – ‘Upholding Civil Liberties in the Digital Age: Privacy, Surveillance and Free Speech’, he said, “There is a flip side to adopting privately owned platforms as the medium for dissent, activism, and expression of free speech. With corporations wielding such immense power, there is an immense amount of trust placed on them to act as the arbiters of acceptable and unacceptable speech – a role that was earlier played by the state itself. “Warning of a disastrous impact on society, public and countries, he quoted a UN report that detailed how the Myanmar military used social media as a tool for ethnic cleansing.
“Unlike state actors, who are held accountable to the Constitution and the electorate, social media platforms are relatively unregulated. This is another novel challenge that digital liberties activists have to find unique solutions to,” he said.

CJI Chandrachud calls for greater inclusivity and female representation in legal profession

Referring to another facet of social media that drowns facts with distortions, Justice Chandrachud said, “With the advent of troll armies and organised disinformation campaigns across different social media platforms, the fear is that there is an overwhelming barrage of speech that distorts the truth.” The CJI dealt with another argument that information technology had been of great assistance to the state machinery in reach-ing the welfare scheme benefits to disadvantaged sections of the society and said use of information technology has given rise to privacy breach concerns.
He said, “I would like to dispel the claim that economic status and access to welfare entitlements are more important than civil and political rights for socio-economically disadvantaged communities. All individuals, regardless of their socio-economic status are deeply impacted by violations of the right to privacy, autonomy, and intimacy….. In the realm of Artificial Intelligence, we find that the unchecked algorithms used by tech giants compound privacy concerns.”
Searching for a protected space for privacy and civil liberties in the digital era, the CJI flagged two issues – “First, the unprecedented proliferation of disinformation and hate speech on the internet has offered a serious challenge to the traditional ways of understanding free speech in a democracy.”


Row Over Bills: Can governor withhold assent to bill for years to kill it: Supreme Court | India News

NEW DELHI: Governor of Tamil Nadu R N Ravi reserving 11 bills for the President’s consideration, allegedly in defiance of the cautionary notes sounded by the Supreme Courtevoked a strong reaction from a CJI-led bench on Friday which asked, “Can the governor withhold assent to bills for years to kill the legislation?”
Appearing for the DMK government in Tamil Nadu, senior advocate A M Singhvi and P Wilson informed the bench of CJI D Y Chandrachud and Justices J B Pardiwala and Manoj Misra that after the SC issued notice on the state government’s petition against delaying tactics by the governor, the latter returned the bills on November 13, which were re-passed by the assembly on November 18.

The governor referred all the 10 bills as well as one pending with him since January 2020 for the President’s consideration on November 28, Singhvi said.

He cited the SC’s recent order relating to similar actions by the Punjab governor in which the court had ruled that only three options were available to the governor – grant of assent to a bill, withholding assent and granting it once the bill was re-passed by the assembly, and reserving it for the President’s consideration. “He cannot reserve a bill, which has been re-passed by the assembly for the President’s consideration,” Singhvi argued.

Gautam Kumar (23) got a teacher’s job in Bihar’s Vaishali district just 12 days back, after he cleared the Bihar Public Service Commission (BPSC) exam.
He was abducted, per eyewitness accounts, from the school by men who sped off in an SUV.

‘Marriage’ followed. Given the choice of tying the knot or getting shot, Kumar did all the things grooms do in traditional Hindu marriage ceremonies. A viral photo in social media shows Kumar and his ‘bride’ in wedding finery.
Luckily for him, the teacher was rescued by the cops, who have arrested Brij Bhushan Rai on charges of abduction.
The bride’s father Rajesh Rai and three other accused are absconding.
Kumar has recorded his statement about the incident in the local court. His relatives fear retribution from the ‘bride’s family’.
But the teacher isn’t the first victim of a case of marriage via kidnapping, nor is likely to be the last. Only recently, Patna high court judged an earlier wedding at gunpoint as null and void. Local academics say there are many cases where the bride’s family is more powerful, and the groom’s family stays quiet, out of fear.
Guns and gangs though are the symptoms not the cause of marriage via kidnapping. Bihar’s lack of enough educated, employed young men prices out many young women’s families from the marriage market – that’s the trigger.
An arrest or two probably won’t discourage other families planning on abducting suitable boys.


Mahua Report: Ethics panel report on Mahua in Lok Sabha on Monday | India News


Setting the stage for a fiery start to the winter session of Parliamentthe Lok Sabha ethics panel’s report on Trinamool Congress MP Mahua Moitra will be tabled on the very first day of the session on Monday.

In the list of business uploaded on the Lok Sabha website, the matter is mentioned at item number 5 as per which ethics committee chairman and BJP MP Vinod Kumar Sonkar and his party colleague Aparajita Sarangi will lay the report a few minutes after the start of the session.

The committee had on November 8 adopted a report recommending Moitra’s expulsion from the lower House over ‘cash-for-query’ charges.

Mahua Moitra’s login credentials weren’t limited only to Hiranandani, alleges Nishikant Dubey.

While six members had voted in favour of the report, including Congress’s rebel MP Praneet Kaur, four opposition MPs had opposed it.
Sources said after laying of the report, junior parliamentary affairs minister Arjun Ram Meghwal is likely to move a motion to accept the report and adopt the recommendations of the committee, which, as per sources, has recommended Moitra’s expulsion. Sources said the opposition may ask for a discussion, which, however, is the sole discretion of the speaker who may allow it or adopt the motion without any debate.
Since the BJP has a majority, adoption of the report is a legislative formality, paving the way for the Trinamool MP’s expulsion. This is the first time since the ethics committee came into existence in 2000 that it has recommended expulsion of a parliamentarian. The privileges committee has taken such steps, including recommending expulsion of 10 MPs in the 2005 cash-for-query scam.


Government: Centre bans e-commerce firms from using ‘dark patterns’ for sales | India News


NEW DELHI: The government has banned the use of “dark patterns” — purposefully designed deceptions — by e-commerce and all other online platforms while selling goods and services that manipulate customers and nudge them into signing up for or purchasing things they didn’t mean to or lure them to buy a more expensive product. The government has notified resorting to this as an “unfair trading practice”.
Under the Consumer Protection Act, offenders can face fines and penal action from the Central Consumer Protection Authority (CCPA) and can also be tried in the consumer commissions.
In a gazette notification issued by the CCPA titled “Guidelines for Prevention and Regulation of Dark Patterns”, the authority has defined “dark patterns” as any practice or “deceptive design pattern” using user interface or user experience interactions on any platform that is designed to mislead or trick users to do something they did not intend or want to do.
The guidelines that have legal backing will apply to all platforms, systematically offering goods or services; advertisers and sellers.
The ministry has defined 13 deceptive practices that will be treated as ‘dark patterns’ and these include creating false urgency by creating an artificial sense of scarcity; basket sneaking, where the inclusion of additional items such that the total amount payable by the user is more than the amount payable for the product as well as subscription trap.


IIT Placements: ₹ 1 crore-plus offers made, but IIT placements off to slow start | India News


MUMBAI: The premier IITs began their placements on a quiet note on Friday. Day 1 saw the crore-plus packages coming in, but it left everyone with a question on whether this will be a happy season for all.
The number of participating companies at IIT-Bombay are almost the same as last year—around 350. The number of job announcement forms(JAFs), however, are fewer as compared to last year.These are forms filled by companies enlisting information regarding job profiles which they are looking for. While 450 JAFs have been filled, last year there were more than 500 JAFs, a source said.
The first day saw around 40 companies holding interviews in two slots. Compared to last year’s Day 1, 80% of the regular recruiters participated this year. Three PSUs —HPCL, C-DOT and ONGC —have already recruited students. The companies that participated on Friday for domestic profiles included Google, Apple and Microsoft.
Barclays is offering Rs 1 crore-plus offers for postings in Singapore. Qualcomm also offered high packages and came with multiple roles —salary packages ranged from Rs 40 lakh to Rs 60 lakh. Of the consultancy firms that descended on the campus in slot 1, some of the regulars that were missing included Bain, BCG, Morgan Stanley, Databricks.
Da Vinci Derivatives, Hudson River Trading, Quantbox Research, NK Securities and Graviton Research are some of the high-frequency trading firms offering crore-plus packages at the institute this season. Jane Streetwhich had made the top offer last year, was conspicuous by its absence.
The institute saw a marginal increase in the number of pre-placement offers (PPOs) accepted—from 194 last year to 200.
Ola CEO Bhavish Aggarwal on Thursday wrote on social media platform X, “Doing many day 0 campus interviews today at IITs. Such bright and energetic young people! Can’t be more excited about the future of our country!!…Will also be at IIT-B tomorrow morning 3am to hire day 0 from my college when I didn’t get a day 0 job myself.”
By the end of the first slot on Day 1 at 1pm, IIT-Roorkee had already secured three international offers and 358 domestic offers. Its statement mentioned that the institute had received the highest international salary as compared to last year. Some of the notable recruiters include Cohesity, Databricks, Flipkart, Google, Hilabs, HPCL, Indus Insights, Intel Technologies, Microsoft, Nvidia, Qualcomm among others.
IIT-Guwahati, till Friday evening, had around 11 offers above Rs 1 crore, as opposed to seven in 2022-23. Around 60 companies had made around 165 offers till 5.30pm on Friday. This was marginally higher than last year. The institute recorded 214 PPOs this year.

Action and stunt director Parvez Shaikh has opened up about designing intense action and war sequences in director Meghna Gulzar‘s Friday release Sam Bahadur and how Vicky Kaushal underwent rigorous training in his portrayal as India’s first Field Marshal, Sam Manekshaw.
Speaking to eTimes, Parvezsaid, “We tried to keep the action and war scenes as real as possible keeping the actors alive.I have not seen a lady director who goes as much in detail as Meghna Gulzar ma’am does. We designed action according to her vision and we think that we have done a good job.”
He further added, “We watched a few videos to get references to warfare during the 1971 war. But we designed the action according to Meghna ma’am’s vision and our sensibilities. We followed her research to design action.”
Talking about Vicky’s dedication and preparation for his role, Parvez said, “Vicky has put his heart and soul into the film. He has done his action himself whether it was getting hit by a bullet, boxing, etc. He did a lot of hard work. He underwent rigorous training for his boxing sequence, high jump, and hurdle jump. In the scene where Sam Manekshaw gets hit by bullets, retakes were happening because of our timing. But Vicky never complained although we made him do that scene 7-8 times.”

He also revealed that they shot the Bangladesh sequences with the local crowd by getting them together and training them. For the Mukti Bahini sequence also, they tried to keep it as real as possible.
“We used stunt artist only where there was danger. Otherwise, we shot with real people. We got about 100-150 people for the sequences shot in West Bengal and Delhi,” Parvez concluded.

Sam Bahadur is based on the life of India’s first Field Marshal Sam Manekshaw. His career in the army spanned over four decades and five wars. He was the first Indian Army officer to be promoted to the rank of Field Marshal and he lead the victory in the 1971 Indo-Pak war, which led to the creation of Bangladesh.

In his military career, Manekshaw played a crucial role in the Indo-Pak War of 1947 and the Hyderabad crises of 1948. Manekshaw then led the Indian Army and came out victorious in the Indo-Pak war of 1971.
The film also stars Fatima Sana Shaikh and Sanya Malhotra in prominent roles. It marks Vicky’s second collaboration with Meghna Gulazar after Raazi.

Cops book Kashmir X user for hurting religious sentiments of Hindus | India News


JAMMU: A case has been registered against a social media user from Kashmir for allegedly hurting religious sentiments of Hindus by posting some objectionable content on X (formerly Twitter), Dr Vinod Kumarsenior superintendent of police, Jammu, said on Friday.
Sharing details, National president of Ekam Sanatan Bharat Ankur Sharma wrote on his X handle that Ekam Sanatan Bharat Dal’s Ajay Singh Saini on Thursday got an FIR registered against “jihadist” iamkashmiri66 (X handle) for hurting Hindus’ religious sentiments by depicting Lord Shiva as porn star Johnny Sins.
This FIR comes in the backdrop of students of various educational institutions in the Valley, including NIT-Kashmir and SKUAST-Kashmir, protesting against an alleged “blasphemous message” posted by a NIT student.

Joint Indo-US space mission Nisar set for March launch | India News


MUMBAI: Nasa administrator Bill Nelson announced on Friday that a major joint Indo-US space missiondesignated Nisar (Nasa-Isro Synthetic Aperture Radar) is provisionally slated for launch in March.
In an interaction with media at the US Consulate, he said that the launch of Nisar will mark a major milestone in the Indo-US space tie-up. “We are all very excited about this flight,” he added.
The 14th Nasa administrator said that the primary role of the mission would be to learn about Earth and protect it.“It will study and measure Earth’s changing eco-systems and support a host of other applications,” added Nelson, who has trained and flown inNasa’s space shuttle Columbia in 1986, and orbited the earth 98 times over six days.
“I saw the spacecraft at Bengalaru yesterday (Thursday) and as of now everything is progressing smoothly,’’ he said while inviting the Mumbai media to witness the launch at the Satish Dhawan Space Centre.
Referring to future areas of Indo-US space collaboration, he said that an Indian astronaut will be trained by Nasa and flown to the International Space Station (ISS) towards the end of 2024 where he will conduct research for 10 to 14 days.
About the ground-breaking success of Chandrayaan-3he said many nations have attempted to touchdown near the South Pole region of the Moon, but none succeeded. “Only India succeeded and my heartiest congratulations to Isro,” he said.
In view of this country’s record-breaking space flights, he said the US decided to team up with India in the space sector more than a decade ago because the American government knew about India’s strong capabilities in the scientific and technical areas. “India had the expertise and we decided to join hands,” he said.
Nelson stressed that it was important to keep the two governments together, while pointing out that the ties between India and the US could not be better and stronger now especially in the space field.
He said that the space collaboration will also include the commercial sector which is why he visited Mumbai. On Thursday, he was in Bengaluru where he also visited his old friend, Rakesh Sharma, India’s first astronaut.
About US missions, he described the recent explosion of Space X’s second Starship mission as a “learning curve”. “The philosophy of Space X is testing, developing and designing,’’ he added.
He said that the first woman astronaut will land in Moon’s South Pole region in Nasa’s Artemis-3 mission along with three male crew members. The date of the launch is, however, yet to be decided. The lander for this mission will be provided by the private sector.
