Jain said that Income Tax Act Section 56 (2) (x) mentions tax rules on gifts. According to this, if a person has received a gift of up to Rs 50,000 or several gifts in a financial year, then he will not be taxed. But, if the value of gifts is more than Rs 50,000, then he will be considered the income of the person he has received. On this, that person will have to pay tax. The tax rate will be according to its tax slab.

He said that the gift from some relatives does not come under the scope of tax, no matter how much his value is. As far as Hindu undivided family (HUF) is concerned, all its members are considered relatives. Therefore, a gift from HUF member will not come under tax for HUF. However, the provision of clubbing will apply to this. This means that the person who has given the gift on the income from the gift.

Linnial disorders of a common easester are members of HUF. HUF will have a doer, will be spijies and children born to him. Father and father -in -law cannot be associated with HUF as a member. The reason for this is that they do not fall into the line of disorders.

Since, Manoj Saha’s father and his father -in -law are not members of HUF, from which the gift from him will come under the scope of tax. He will be taxed that year the year he has received. If it is not shown in income tax return, then penalty may be imposed, which will be 200 percent of the outstanding tax. Apart from this, regular tax and interest will also be levied. Jain said that it is beneficial for HUF to file ITR Income Tax in the new regimen. Tax is less in this.

NEW DELHI: The Delhi high court on Monday set aside order directing CBSE to provide information under the Right To Information (RTI) about whether Smriti Irani had cleared her 10th and 12th examinations in the year 1991 and 1993.Justice Sachin Dutta ruled that the entire approach of the Central Information Commission (CIC) in the impugned order was “thoroughly misconceived”.“The conclusion that information relating to degree/marks/results of any particular individual is in the nature of ‘public information’, is in direct and utter contravention of the judgment of the Supreme Court in Central Public Information Officer, Supreme Court of India v. Subhash Chandra Agarwal (supra),” the bench ruled according to Bar & Bench.Irani’s degrees sparked controversy after a petitioner alleged that she had given contradictory information in her affidavits filed before contesting elections in 2004, 2011 and 2014. In her affidavit for the 2004 Lok Sabha polls, Irani had said she completed her BA in 1996 from DU (School of Correspondence as SOL was then called), whereas in another affidavit on July 11, 2011 to contest Rajya Sabha election from Gujarat, she had said her highest educational qualification was BCom Part I, a petitioner had alleged in court.Earlier, the court also quashed CIC’s order that had directed disclosure of details regarding Prime Minister Narendra Modi’s bachelor’s degree. Justice Datta gave the judgment, which had been reserved on February 27, after hearing a petition filed by Delhi University against the CIC order. The case began with an RTI request filed by a man named Neeraj. In December 2016, the CIC had allowed people to inspect the records of all students who passed the BA exam in 1978, the same year PM Modi completed his graduation. The Delhi high court had earlier put a stay on the CIC order on January 23, 2017. During the hearing, Solicitor General Tushar Mehta, representing Delhi University (DU), argued that the CIC order should be cancelled. He said the university had no problem showing the records to the court itself. “University has no objection in showing the record to the court. There is a degree from 1978, Bachelor of Arts,” Mehta stated.

Mysuru woman mysteriously killed by her lover at lodge room | Mysuru News

MYSURU: A jilted lover has detained by Mysuru police for mysteriously killing a woman in a lodge room in Saligrama, Mysuru, supposedly using electrical object. Police suspect the accused may have used a pressure-triggering object or electric power to kill her.When police arrived, Darshitha, a mother in her early 20s, was lying dead in a pool of blood on the floor of the room in Bherya village, about 55 km from Mysuru city, on Saturday. Her mouth and face were badly wounded. Siddaraju, from Bettadapura village, Periyapatna, who brought Darshitha from Gerasanahalli, Hunsur to the hotel, was detained. He committed the crime as she refused to marry him, according to the police. Siddaraju worked at a hardware shop while she lived with her parents in Hunsur, and her husband was in Kerala. Superintendent of Police, Mysuru, N Vishnuvardhana, said Saligrama police are being assisted by a forensic science expert to identify the object used to kill the woman. He, however, ruled out the use of gelatine sticks or any explosive materials to injure and kill the woman. An investigation is being carried out to identify the object used to cause her severe bleeding in her mouth, which led to her death.Sources claim the accused may have used electric power. Two metres of electric wire were recovered from the spot.According to lodge manager Manu, the duo arrived seeking a room around 2 pm on August 23. The man introduced himself as Siddaraju and Darshitha as his wife. They went to their room, and after some time, Siddaraju came out and asked if food was available. Our staff member informed him that food was available next to our lodge. He said he would go to get food, left, and returned with something in a plastic cover. He then went to the room but came back saying he couldn’t open the door. Immediately, lodge staff went with him to check why the door wasn’t opening and later managed to open the door using a cutting tool. To their shock, they found Darshitha, with a severe wound from her mouth to her neck, lying dead beside the bed in a pool of blood, police explained.Police said the room had an automatic lock and would close when the door was shut.Siddaraju attempted to carry Darshitha’s body away on his shoulder, claiming he would take her body. The hotel staff stopped him, telling him not to move the body until the police arrived, police stated.An officer said the accused had told police that she may have died after coming in contact with electric power through a mobile phone but there are no such traces. He was later picked up on suspicion and arrested for murder. Siddarajau has been remanded to judicial custody, and he will be taken into police custody for further investigation after the FSL report.

Next-generation reforms in works

In Parliament, Jan Vishwas 2.0 was recently introduced. Regarding the next phase of reforms that PM Narendra Modi announced during his Independence Day speech, Goyal said there are numerous possibilities under consideration.“We are looking for ideas big and small…we would like to decriminalise as many laws as we can, reduce regulatory burden on industry. Maybe we won’t be able to deliver 100% but we’ll make a sincere effort…We have decriminalised 355 sections in Jan Vishwas Bill 2.0, I want to take it up to 1,355. The select committee is going to be seeking suggestions. If required, I’ll introduce a completely new bill,” he said.Regarding policies, particularly for labour-intensive sectors, a GST restructuring is under consideration. “We’ll see how we can support many of these labor intensive sectors, like food processing, textile through the GST framework to give a boost to domestic demand. Our ministry and different line ministries are already looking at complementarity of our strength areas with other economies,” he said.
