Rebellion is such that the government does not survive
Like Madhya Pradesh, with complete planning, a blueprint was prepared to bring down the Uddhav government. When the Kamal Nath government was formed, the Congress itself had 114 seats. There was support of 7 more MLAs. The total number was 121. The majority figure is 116. BJP had 109 seats. 22 Congress MLAs rebelled and with this the fall of the government was decided. The same situation happened with the Uddhav government of Maharashtra. Shiv Sena’s strongman Eknath Shinde revolted with full planning. The process which started with 25 rebel MLAs reached 39 MLAs.

To save his government, Uddhav Thackeray issued notices to the rebel MLAs through the Deputy Speaker. Kamal Nath did exactly the same thing two years ago. His attempt was to somehow get constitutional approval for the resignation of the rebel MLAs, so that the government could prove majority in the floor test, but they did not get relief from the Supreme Court. The same happened with the Uddhav government and the way was cleared for the formation of the BJP government.

Kamal Nath had to resign due to such a situation
After the resignation of 22 MLAs in Madhya Pradesh, the Governor had ordered the Kamal Nath government to conduct a floor test. The Kamal Nath government argued that the disqualification of the MLAs is pending with the speaker, so the governor cannot ask for the floor test, but the Supreme Court refused to stay the floor test. A similar incident was seen in the political drama of Maharashtra. Like Kamal Nath, Uddhav Thackeray also had to resign from the post of Chief Minister before the floor test.

Supreme Court has already said – floor test cannot be stopped
On 13 April 2020, Justice DY Chandrachud of the Supreme Court, in Shivraj Singh v Speaker, held that the floor test cannot be stopped due to pending disqualification proceedings against the MLAs. The Supreme Court had also clarified that there was no need to stop the floor test as the Speaker had not decided on the resignation of MLAs and defection as per the 10th Schedule of the Constitution.

Shinde got the post of CM, Scindia was sent to the center
Jyotiraditya Scindia, who rebelled in the case of Madhya Pradesh, was sent to the Rajya Sabha and made a minister at the Center, while most of his supporters were made ministers. At the same time, Eknath Shinde, who rebelled in the case of Maharashtra, has been made the Chief Minister.
