Gujarat Vidyapeeth’s Vice Chancellor (Vice Chancellor) Dr. Directed Gujarat Vidyapeeth to remove Rajendra Khimani from his post. Against this decision of UGC, Dr. The High Court has disposed of the application made by Rajendra Khimani. The High Court has directed the Gujarat Vidyapeeth to hear the petitioner and comply with the directions given by the UGC within eight weeks. The High Court said that they doubt that Vidyapeeth will do this right? The High Court has also said that it will not interfere with the decision of the UGC, but the petitioner should be heard. The decision to remove the Vice Chancellor is taken by the Chancellor.
Counsel for the UGC submitted that the appointment of the petitioner as the Vice Chancellor of Gujarat Vidyapith was not made in accordance with law. The applicant has been the Registrar of Gujarat Vidyapith from 02-02-04 to 31-04-19. During this period he committed financial and administrative malpractices. A fact finding committee was formed to investigate this issue and the investigation committee has given its report. Based on which it has been decided to remove the applicant from the post of Vice Chancellor.
A three-member committee is constituted for the appointment of the Vice Chancellor. In which, one member is nominated by the Chancellor, another member is on behalf of the Central Government and the third member is from the Board of Management. In which the member appointed by the Center was of the opinion that since the UGC inquiry against the applicant is pending, he cannot be appointed as Vice Chancellor. The Vice-Chancellor is a full-time salaried employee. If a person is not qualified as Vice Chancellor as per UGC rules then he can be removed by UGC. So the UGC directed the Gujarat Vidyapeeth to remove the petitioner from the post of Vice Chancellor. If this directive is not followed, there will be a duty to stop the grant received by Gujarat Vidyapith.
It was submitted by the counsel for the petitioner that, as Vice Chancellor, he is well qualified. A unilateral decision cannot be taken without giving them an opportunity of representation. So cancel the decision of UGC.
