The Supreme Court has given its verdict on the petition filed by the BCCI regarding the change in the constitution. After this decision, BCCI President Sourav Ganguly and Board Secretary Jay Shah can remain in their posts for the next three years.

Big relief for Ganguly-Jay Shah from Supreme Court

Board of Control for Cricket in India (BCCI) President Sourav Ganguly and Secretary Jay Shah have received a major relief from the Supreme Court of the country. Both may continue in their positions in the BCCI for the next three years. On Wednesday, the Supreme Court has given this decision in a petition related to amendment in the constitution of BCCI. That means there is no crisis on the tenure of BCCI President Sourav Ganguly, Secretary Jai Shah.

No cooling-off period required: SC

The Supreme Court in its decision has said that there is no need for a cooling-off period after one tenure of the BCCI, but it has to be done after two terms. It is clear from the Supreme Court’s decision that Sourav Ganguly and Jay Shah can remain in their posts for the next three years.

When did Ganguly’s tenure end?

Former Team India captain Sourav Ganguly took over as the BCCI President on 23 October 2019, while Jai Shah became the BCCI Secretary on 24 October 2019. In such a situation, the tenure of both was ending next month i.e. in October 2022. It was for this reason that the BCCI appealed to the Supreme Court for an early hearing of the petition relating to the matter.

He can stay on his post till 2025

Now both have got relief from the Supreme Court, so both can stay in their posts till 2025. This decision of the Supreme Court is not only for the Board President and Board Secretary but also for all officers/positions of BCCI and State Association.

The Supreme Court accepted the appeal

The BCCI had appealed to the court to allow its officials to continue for two consecutive terms, one of which could be associated with the state association. The Supreme Court has accepted this appeal. Now if an official completes two consecutive terms in the same post in BCCI then he has to have a cooling period of 3 years. While in a state association, this cooling off period will be two years.

What is this BCCI case?

The BCCI constitution, which came into effect in 2018, stipulated that any official completing two terms at the state or BCCI level would have to complete a cooling-off period of three years. In such a case, on completion of 6 years, the person himself will be completely out of the electoral race.

Petition for change in constitution by BCCI

BCCI filed a petition in the Supreme Court appealing that this rule be allowed to be changed. The BCCI, in its petition, said things like the cooling off period should be scrapped, the secretary should have more powers and the board should not have to go to court if it wants to change the constitution.

A big decision of the Supreme Court

During the hearing on Wednesday, the court said in the matter that prima facie we are of the view that there is no need for a cooling-off period for a term in the BCCI after a term (3 years) in the state association. But after two terms in state association or BCCI cooling off has to be kept. A person who has served two consecutive terms of 3 years in the state or BCCI has no problem.
