The High Court dismissed the plea against the UGC's decision to remove the Gujarat Vidyapeeth VC

The Vice Chancellor (Vice-Chancellor) of Gujarat Vidyapeeth Dr. Removed Rajendra Khimani from his post. The High Court has rejected the petition filed by Rajendra Khimani against this decision of the UGC. The High Court has ordered the Gujarat Vidyapeeth to comply with the directions given by the UGC within eight weeks. The High Court observed that the UGC followed all the procedures and took the decision.

Submission of counsel for UGC

The counsel for UGC submitted that the appointment of the petitioner as Vice Chancellor of Gujarat Vidyapith was not made as per law. The applicant has been the Registrar of Gujarat Vidyapith from 02-02-04 to 31-04-19. During this period he committed financial and administrative malpractices. A fact finding committee was formed to investigate this issue and the investigation committee has given its report. A central government-appointed member of the three-member committee for appointment of the vice-chancellor was of the view that the applicant should not be appointed as the UGC inquiry is pending against him. This matter has been mentioned in the report of the inquiry committee appointed by the UGC. On the basis of which it has been decided to remove the applicant from the post of Vice Chancellor. The Vice-Chancellor is a full-time salaried employee. If a person is not qualified as Vice Chancellor as per UGC rules then he can be removed by UGC. So the UGC has directed the Gujarat Vidyapeeth to immediately remove the petitioner from the post of Vice Chancellor. If this directive is not followed, it will be forced to stop the grant received by Gujarat Vidyapith.

Dr. Rajendra Khimani’s counsel submitted that he has the right qualifications as the Vice Chancellor. The UGC has taken a unilateral decision without giving them an opportunity to present themselves. This decision of UGC is invalid, annul it.

Presentation of Gujarat Vidyapith

The lawyer of Gujarat Vidyapeeth submitted that Gujarat Vidyapeeth is a deemed university. The UGC has no power to remove the Vice Chancellor. After all the process, the applicant is appointed as Vice Chancellor.
