These candidates were shortlisted for the job of airmen in the Air Force under the notification issued in 2019. But due to Kovid, this government recruitment process was delayed. Now with the advent of the Agneepath project, the Army has canceled the old pending vacancy. Disturbed by this, the candidates have filed an application in the Delhi High Court. It said that the Air Force should release the nomination list for the old candidature and complete the old recruitment process without being affected by the Centre’s new Agneepath recruitment scheme for the Armed Forces.

IAF Agnipath PIL: What arguments are given in the petition?

The nomination list containing the names of the selected candidates as per the recruitment scheme should be published on July 10, 2021. But it has not been published yet.

The Central Airman Selection Board released statements on its official website stating that the announcement of results was delayed due to cowardice and administrative reasons. The Center then launched the new Agneepath project in June this year and the Air Force invited applications for various positions in the Air Force through a notification dated June 24, 2022. The notification also includes posts coming under 2019 recruitment.

If the recruitment process had reached the last stage, the decision to cancel it completely and then start a new selection process to implement the Agneepath scheme is arbitrary.

The act of canceling the next recruitment for this post is discriminatory. This is a violation of Article 14 of the Constitution.

“Absolute cancellation of the recruitment process initiated by the 2019 notification is illegal, arbitrarily violating the rights of applicants guaranteed under Article 16 (1) of the Constitution of India.”

Agniveer Recruitment: More such applications

A division bench of Justice Suresh Kumar Kait and Justice Saurabh Banerjee on Tuesday adjourned the petition for two weeks in view of the pending case before the Supreme Court, which is scheduled to be heard next week.

The petition seeks directions to the Center to publish the nomination list with reference to the 2019 notification and consequently to publish the appointment letters to the applicants. It has also been demanded that the Agneepath scheme should not affect the 2019 notification.
