Mumbai: The Mumbai High Court recently delivered a landmark judgment. The court said the woman should not be asked to choose between her child and her career. A single bench of Judge Bharti Dangre was hearing a woman’s application seeking permission to move to Poland with her nine-year-old daughter. A woman working in a private company in Pune got a project in Poland. However, the woman’s husband opposed the petition, claiming that he would not be able to see her again if the child left her. The woman’s intention was to remove the father-daughter.
Earlier, the hearing was held in the Family Court and the woman was barred from shifting to Poland with her daughter. However, as the woman was not satisfied with the verdict, she knocked on the door of the high court and the court said that a woman cannot be asked to choose between her child and her career. The possibility of a woman’s career cannot be ruled out. The custody of the daughter is still with her mother so considering the age of the daughter it is necessary that she stay with her mother. The court does not think that a mother can be prevented from taking a job, that a balance must be struck between the interests of both mother and father, and that the child’s future must be taken into account.
